Objective;
- To protect INCEIF from legal suits arising from Intellectual Property (IP) related suit particularly concerning plagiarism.
- To provide guidance to INCEIF’s students whose work requires the citing of the work of other authors.
- To provide guidance to INCEIF’s students concerning their internal research output and publication with regard to their ownership right.

| POLICY STATEMENT |

That INCEIF respects the ownership right of others and students should at all times respect them.
It is the policy of INCEIF that all Copyright shall remain with the creator of the work subject to an appropriate written consent is obtained. |

| DEFINITION |
|
|
Copyright
- Copyright is the ownership and control of IP in original works of authorship. Copyright ownership and the rights hereof are defined by the Malaysian Copyright Law 1987.
- Infringement in relation to Copyright means any reproduction of any work eligible for copyright under the Malaysian Copyright Law 1987 the making of which constitute an infringement of the Copyright in the work or, in the case of any article imported into Malaysia without the consent of the owner of the Copyright, the making of which was carried out without the consent of the owner of the Copyright.

Copyright which subsists in a published edition under Malaysian Copyright Act shall continue to subsist until the expiry of a period of 50 years computed from the beginning of the calendar year following the year in which the edition was first published.

| INFRINGEMENT OF COPYRIGHT WORK |
|
|
The Copyright in a work is infringed when a person who, not being the owner of the Copyright, and without license from the owner, thus or authorize any of the following act;
- Reproduces in any material form to the public communicate by cables or broadcast of the whole work or a substantial part thereof in its original and derivative form.
- Imports any articles into Malaysia for the purpose of trade or financial gains.
Makes, lets for hire or by way of trade, exposes or offers for sale or hire any infringing copy.
- Sells, lets, for hire or by way of trade, exposes or offers for sale or hire any infringing copy.
- Distribute infringing copies.
- Possesses, otherwise then for his private or domestic use, any infringing copy.
- By way of trade, exhibits in public any infringing copy.
- Imports into Malaysia, otherwise that for his private and domestic use any copy which if it were made in Malaysia would be an infringing copy.
- Makes or has in the possession any contravene used or intended to be sued for the purposes of making infringing copies; or

Cause the work to be performed in public.

| LEGAL RIGHT OF COPY RIGHT OWNERS |

The owner of Copyright works has the exclusive right to;
- Reproduce the work in any material from (including photocopying, recording etc).
- Perform, show or play the work to the public (including performing a work live).
- Broadcast the work.
- Communicate the work by cable; and
- Distribute copies of the work to the public by sale, rental or lending.

| LICENCE TO PUBLISH |
|
|
The owner of Copyright works has the exclusive right to;

Distribute copies of the work to the public by sale, rental or lending.

| IMPLEMENTATION OF THE POLICY |
|
|
All students shall execute the Letter of Undertaking as per Appendix 1. The Letter of Undertaking should be submitted to The Head of ASAD.
- All students who require to download materials from the website of other institutions and subsequently to reproduce it in whatever form shall seek prior written permission using the Letter of Consent as per Appendix 2.
- For reproduction of printed materials partial or full, where permission from the copyright owner is required, staff shall use the Letter of Consent as per Appendix 2.
- All students are required to file a copy of the Letter of Undertaking/ Letter of Consent with the ASAD Department.

| CUSTODIAN |
|
|
| The ASAD shall be the custodian of the policy. |
|

|
|
|
| POLICY REVIEW |
|
|
| This policy will be reviewed at least every 2 (two) years or as circumstances require. It shall be tabled and approved in the INCEIF management meeting. |
